A fierce debate is unfolding in Minnesota over proposed gun control legislation, with accusations surfacing that lawmakers are prioritizing emotional appeals over substantive policy discussion. Amy Swearer, a Second Amendment expert, alleges a deliberate effort to sideline expert voices as Democrats push for passage of two controversial bills.

Swearer, a senior legal fellow specializing in gun policy, claims her written testimony was arbitrarily rejected by a House panel before a crucial hearing. Despite the setback, she was eventually granted a brief two minutes to speak, a concession she believes was made only to avoid appearing completely closed off to opposing viewpoints.

The core of the issue, according to Swearer, is a desire to keep the focus squarely on the emotional weight of the Annunciation Catholic Church shooting in Minneapolis. She contends that lawmakers actively sought to prevent a detailed examination of whether the proposed policies would have actually prevented the tragedy.

The hearing itself was marked by powerful testimony from parents and victims of the shooting, including Jackie Flavin, who heartbreakingly described a community forever changed by the loss of her 10-year-old daughter, Harper. Flavin’s words painted a stark picture of the constant fear parents now face.

Currently, the two bills are stalled in committee following a 10-10 party-line tie vote. One bill aims to broadly ban the sale of “semiautomatic military-style assault weapons” through a redefinition under state law, while the other seeks to prohibit large-capacity ammunition magazines holding more than ten rounds.

Swearer’s rejected testimony included an analysis of multi-victim shootings within the state, a perspective she believes was deliberately excluded. She alleges a selective enforcement of committee rules regarding hyperlinks was used to silence her, while others were permitted to submit similar materials.

The expert argues the bills are unconstitutional and represent one of the most restrictive gun bans she has ever encountered. She emphasizes the importance of a policy debate grounded in facts, rather than solely driven by grief and outrage.

Anna Leamy, director of governor relations for the Minnesota Gun Owners Caucus, also testified against the bills, echoing concerns about limited participation from experts and concerned citizens. The caucus had initially invited Swearer to present her analysis.

Restrictions on witness participation are common in committee hearings, often due to time constraints. However, these limitations have sparked accusations of selective suppression, with the National Foundation for Gun Rights also reporting that its executive director was denied the opportunity to testify.

The proposed legislation stems from a sweeping gun control package introduced by Governor Tim Walz in response to the devastating church shooting, igniting a passionate and deeply divisive debate within the state.
